CO-TENANCY AGREEMENT

THIS CO-TENANCY AGREEMENT (the "Agreement") is entered into as of _DATE_ (the "Effective Date"), by and between:

PARTIES:

1. [CO_TENANT_1_NAME], having a principal place of residence at [CO_TENANT_1_ADDRESS] ("Co-Tenant 1"), and

2. [CO_TENANT_2_NAME], having a principal place of residence at [CO_TENANT_2_ADDRESS] ("Co-Tenant 2"), collectively referred to as the "Co-Tenants."

BACKGROUND:

WHEREAS, the Co-Tenants desire to enter into a co-tenancy arrangement for the residential property located at [PROPERTY_ADDRESS] (the "Property"); and

WHEREAS, the Co-Tenants are desirous of defining their respective rights and obligations with respect to the use and occupancy of the Property.

NOW, THEREFORE, in consideration of the premises and covenants contained herein, the Co-Tenants agree as follows:

1. TERM: The term of this Agreement shall commence on the Effective Date and shall continue on a month-to-month basis until terminated by either Co-Tenant upon [LENGTH_NOTICE] days' prior written notice to the other Co-Tenant.

2. USE OF PROPERTY: The Co-Tenants agree to jointly occupy and use the Property as their principal place of residence with equal rights of possession.

3. RENTAL PAYMENTS: The monthly rental payment for the Property shall be divided equally between the Co-Tenants. The total rent for the Property is [TOTAL_RENT_AMOUNT], with each Co-Tenant responsible for [INDIVIDUAL_RENT_AMOUNT] per month.

4. SECURITY DEPOSIT: The Co-Tenants shall each contribute an equal share of [SECURITY_DEPOSIT_AMOUNT] as a security deposit for any damages to the Property caused by the Co-Tenants during the term of this Agreement.

5. MAINTENANCE AND REPAIRS: The Co-Tenants agree to maintain the Property in a clean and habitable condition, and to promptly notify each other of any maintenance issues or repairs needed. The cost of repairs due to negligence or intentional actions of either Co-Tenant shall be borne by the responsible Co-Tenant.

6. UTILITIES: The Co-Tenants shall equally share the costs of all utilities related to the Property, including but not limited to water, electricity, gas, and internet.

7. DEFAULT: In the event that one Co-Tenant fails to fulfill their obligations under this Agreement, the other Co-Tenant may provide a written notice of default and allow [CURE_PERIOD] days for the defaulting Co-Tenant to cure the breach. If the breach is not remedied within the cure period, the non-breaching Co-Tenant may terminate this Agreement.

8. GOVERNING LAW: This Agreement shall be governed by and construed in accordance with the laws of [GOVERNING_STATE].
